1. Definitions

  • “We”, “Us”, “Our” refers to Wespow Adventures.

  • “You”, “Guest”, “User” refers to any individual who visits our website, makes a booking, participates in any activity, or uses our services.

  • “Services” means any adventure, tour, activity, package, booking, or experience offered by Wespow, including but not limited to ATV, horseback riding, cannabis tours, agritourism, group, school, or corporate experiences.

  • “Website” means the Wespow Adventures web site and any related mobile or digital platforms.


2. Acceptance of Terms

  • By using the Website or booking any Service, you confirm you are at least the minimum age required (as posted per activity), legally capable of entering into binding contracts, and agree to these Terms.

  • These Terms, together with our Privacy Policy, Safety Rules, Cancellation Policy, and any other policies posted on the Website, form the entire agreement between you and Wespow Adventures regarding your use of the Website and participation in Services.


3. Booking, Payment & Confirmation

  • All bookings must be made through our Official Website, local office, or authorized partners.

  • Payment methods accepted will be clearly indicated at time of booking. Payment, or deposit (if required), is due per the schedule in the package description.

  • Once your booking is confirmed, you will receive a confirmation email or message with details of the activity, date, time, location, and any requirements. It is your responsibility to review that information and ensure it is correct.


4. Pricing & Taxes

  • Prices for Services are as listed on the Website at the time of booking. We reserve the right to change prices at any time without prior notice, but not after you have confirmed a booking.

  • All applicable taxes, fees, and service charges will be included in the quoted price or clearly disclosed.


5. Safety, Rules & Conduct

  • You agree to follow all posted rules, safety instructions, and the directions of our staff/guides. Non-compliance may result in refusal of service without refund.

  • You must disclose any medical conditions, physical limitations, or pregnancy that could affect your participation. We reserve the right to refuse participation (or require medical clearance) for any guest whose condition poses a risk.

  • Use of protective gear (helmets, harnesses, etc.) is mandatory where provided. Guests must use the equipment as instructed.

  • Activities may have minimum and maximum age, height, and weight limits; if you do not meet posted requirements, you may be denied participation.


6. Cancellation, Rescheduling & Refunds

  • Wespow’s Cancellation Policy applies (see Cancellation Policy page).

  • You may request changes to date/time or number of participants; such changes are subject to availability and may incur fees.

  • Should Wespow cancel or modify a Service for safety, weather, or operational reasons, you will be offered options to reschedule or receive refunds or credits, per the Cancellation Policy.


7. Intellectual Property

  • All content on the Website — text, images, videos, logos, graphics — are owned by or licensed to Wespow Adventures and are protected by copyright, trademark, and other intellectual property laws.

  • You may view, print, or download content for your personal, non-commercial use only, provided that you retain all copyright or other proprietary notices. No reproduction, distribution, or commercial use is permitted without express written permission from us.


8. Liability & Warranty Disclaimer

  • Participating in adventure activities involves inherent risks. You acknowledge and accept these risks, including but not limited to physical injury, equipment failure, environmental hazards, and unpredictable behavior of animals.

  • To the fullest extent permitted by law, Wespow Adventures, its employees, agents, or contractors shall not be liable for any injury, loss, theft, damage to person or property arising from participation in Services, except as caused by gross negligence or willful misconduct.

  • Wespow does not warrant that Services will be uninterrupted, error-free, or that any content on the Website is free from errors or omissions.


9. Indemnification

  • You agree to indemnify, defend, and hold harmless Wespow Adventures, its affiliates, officers, employees, agents, and contractors from any claims, actions, damages, losses, liabilities, or expenses (including legal fees) arising out of or related to your violation of these Terms, misuse of the Website or Services, or breach of any representation or warranty made by you.


10. Health & Medical

  • Guests must ensure they are physically and mentally fit for the activities. If you have medical concerns, consult your physician before participating.

  • In case of medical emergency, you authorize Wespow to administer first aid and arrange medical care as needed. You are responsible for any medical costs incurred.


11. External Links & Third-Party Content

  • The Website may contain links to external websites or services that are not owned or controlled by Wespow Adventures. We assume no responsibility for the content, privacy policies, or practices of those third parties.

  • Inclusion of links does not imply endorsement.


12. Changes to Terms

  • We may change or update these Terms at any time. The updated version will be posted on the Website, with the “Effective Date” updated. Continued use of the Website or Services after changes signifies your acceptance of the new Terms.


13. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Jamaica.

  • Any disputes, claims, or legal proceedings arising out of or in connection with these Terms or Services shall be settled in the courts of Jamaica unless otherwise required by law.

  • If any provision of these Terms is held to be invalid or unenforceable by a competent court, that provision will be severed, and the remaining Terms will continue in full force and effect.

Rider Requirements

Your Adventure. Your Safety. Our Priority.

To guarantee that every guest enjoys a fun-filled, controlled, and unforgettable experience, all riders must meet the following safety and performance standards:


Age Requirements

  • Minimum rider age: 16 years old (valid ID may be required).

  • Passengers (for 2-seater ATVs): Minimum 12 years old, accompanied by an adult.

  • Riders under 18 must have a parent or guardian present to sign the waiver.


Weight Limits

For optimal handling and balance on rugged terrain:

  • Maximum rider weight: 275 lbs (125 kg)

  • Maximum combined weight (for 2-seater ATVs): 525 lbs (238 kg)

  • Riders must be able to safely balance, steer, and control the ATV during the entire tour.

Exceeding these limits can impact control, suspension, and safety performance. Guides may conduct a brief pre-ride assessment to ensure proper fit and weight distribution before departure.


Height & Fit

Every rider must be able to maintain full and safe control of their ATV:

  • Hands must comfortably reach all handlebars and brake controls.

  • Feet must reach the footrests while seated upright.

  • Passengers must be securely positioned and able to hold on during movement.

  • If a guest cannot safely operate or fit the vehicle, a suitable alternative may be offered.


Dress Code & Required Gear

The right gear keeps your ride comfortable, controlled, and safe. Please wear:

  • Closed-toe shoes or boots (no sandals or slippers)

  • Long pants or durable shorts

  • Comfortable, fitted tops (avoid loose clothing)

  • Helmet (required and provided)

  • Goggles and gloves (available upon request)

Tip: Bring a change of clothes. Adventure here often comes with a little mud and a lot of memories.


Fitness & Readiness

Our trails are designed for thrill-seekers, not risk-takers. To ride safely, participants should:

  • Be in good physical condition

  • Be able to control and maneuver the ATV confidently

  • Follow all guide instructions throughout the tour

  • Be free from recent injuries or conditions that could affect safe riding

We reserve the right to reassign or restrict participation if a guest does not meet safety criteria. This ensures every rider and every tour stays within the limits of safe adventure.

Guest Responsibilities

Every adventure is a team effort, and your part matters. To help us keep every experience safe, smooth, and exciting, please follow these rules:

  • Listen and Follow Instructions: Our guides know the terrain, equipment, and animals. Always follow their direction before, during, and after each ride.

  • Be Honest About Your Health: Let us know about any medical conditions, recent injuries, or if you’re pregnant. It helps us plan safely and tailor your experience.

  • Dress the Part: Closed-toe shoes are mandatory. Long pants and comfortable clothes are recommended for rides and outdoor trails.

  • Use the Gears Provided: Helmets and protective equipment must be worn at all times when required. They’re for your safety, and they look great in photos, too.

  • Respect Nature and Wildlife: Stay on marked trails, don’t feed animals, and avoid picking plants or crops. We share this land with nature. Let’s treat it with care.

  • Keep Belongings Secure: Carry only what’s necessary for your ride. Phones, cameras, and valuables should be stored safely or kept in waterproof pouches.

  • Speak Up: If you’re unsure, nervous, or notice something unsafe, tell a guide immediately. Your voice keeps everyone safe.

Together, these steps make every Wespow adventure not just thrilling, but safe, seamless, and unforgettable.

A. Before You Arrive

  1. Bookings & Waivers: All guests must complete the online booking form and sign the waiver before adventure. Minors require a parent/guardian signature. No waiver = no participation. (Waivers are standard industry practice to manage risk and informed consent.)

  2. ID & Age Requirements: Guests must bring valid photo ID. Minimum age and driver’s-license requirements apply for certain activities (e.g., solo ATV riders 16+ may require valid ID). Check each activity’s page for exact limits.

  3. Health Disclosure: Disclose any medical conditions, pregnancy, recent surgeries, or medications that could affect participation. Guests with heart, neck, back, or seizure conditions may be restricted from certain activities.

  4. Payment & Cancellation: Full payment or deposit policies and cancellation windows are listed at booking. Last-minute cancellations and no-shows may incur fees.

B. General Park Rules (Apply to All Activities)

  1. Listen to the Guide: Follow all instructions from Wespow staff immediately. Guides are trained for safety and the best experience. Failure to follow instructions may result in immediate removal from the activity without refund.

  2. No Alcohol or Intoxicants: Guests may not consume alcohol or illicit drugs (including using cannabis) before or during adventure activities. Consumption before an activity will lead to refusal of service for safety reasons.

  3. Proper Attire Required: Closed-toe shoes, long pants for ATV/horses, and appropriate clothing recommended. Flip-flops and skirts/dresses are prohibited for active experiences.

  4. Respect the Environment & Farms: Stay on marked trails, do not pick crops or disturb wildlife, and follow agritour rules when visiting farms. Leave no trace.

  5. Photography & Drones: Personal photos are welcome, but drone use requires advance training and permission. Do not interfere with guide instructions to take photos.

  6. Liability & Refusal of Service: Wespow reserves the right to refuse participation to anyone deemed a safety risk or under the influence. Management decision is final.

C. Activity-Specific Rules

ATV Tours

  1. Safety Gear Mandatory: Standard helmet and eye protection are required. Wespow provides and inspects gear before each ride. Guests must wear the assigned helmet and protective equipment at all times while on the ATV.

  2. Licensing & Experience: Drivers must present valid identification and may be required to show a valid driver’s license for solo operation. Rides operate in small guided groups only.

  3. Age/Weight Limits: Minimum and maximum age/weight limits apply (see booking page). Underage guests may ride as passengers with a licensed adult in specific tandem setups.

  4. Trail Conduct: No reckless driving, no stunts, maintain designated speed limits, and follow your guide’s route. Off-trail driving is prohibited.

Zipline & Treetop Adventures

  1. Pre-Ride Briefing & Harness Use: All participants must attend the safety briefing and be fitted with harnesses by staff. Harnesses, trolleys, and lanyards are inspected and used per manufacturer/industry standards.

  2. Weight & Health Limits: Weight ranges and physical fitness requirements apply. Guests with heart, neck, or pregnancy conditions should not participate.

  3. Hands-Free Policy: Keep hands free when zipping (follow staff instructions for photos). Do not attempt to use phones or remove safety equipment while on the line.

Horseback Riding

  1. Helmet & Riding Rules: Approved riding helmets must be worn at all times. Follow the guide’s pace and instructions. Do not pass the guide unless instructed. Approach and mount horses as shown by staff.

  2. Animal Welfare & Respect: Do not feed or tease horses unless guided. Wespow follows animal care best practices; guests must not act in ways that could distress the animals.

  3. Weight/Experience Limits: Weight limits and experience-level restrictions may apply for certain trails to protect both rider and horse.

Cannabis Farm Tours & Agritourism

  1. Legal Compliance & Conduct: Jamaica’s cannabis regulations and the Cannabis Licensing Authority’s educational tour policy govern our tours. Guests must be 18+ (or as required by law) and present ID. Purchases, possession limits, and consumption rules follow Jamaican law. Do not remove or consume products unless permitted.

  2. No On-Site Consumption During Active Adventures: Consumption of cannabis or alcohol before or during physically active experiences is prohibited for safety. On-site educational tastings or licensed dispensary visits (if offered) will follow strict legal and operational rules, including ID checks and limits.

  3. Respect Farm Protocols: Stay on marked paths, sanitize hands when requested, and do not touch plants without guide permission (biosecurity & crop health).

D. Groups, Events & Private Bookings

  1. Group Waivers & Pre-Registration: All group participants must complete waivers. Large groups may have staggered start times and a dedicated lead contact.

  2. Behavior Standards: Organizers are responsible for guest conduct. Excessive noise, unsafe behavior, or property damage will result in immediate ejection and possible liability for damages.

E. Emergency & Medical

  1. First Aid & Emergency Response: Wespow maintains trained staff, first-aid kits, and emergency protocols. In case of injury, staff will provide first response and arrange for additional medical care as needed at your expense.

  2. Insurance & Personal Responsibility: Guests are encouraged to carry travel insurance covering adventure activities; Wespow’s liability is governed by terms in the waiver.

F. How We Enforce These Rules

  1. Staff Authority: Guides and management have final authority to modify, delay, or cancel activities due to weather, safety concerns, or non-compliance.

  2. Refunds & Safety Holds: Refunds are handled case-by-case; safety cancellations (e.g., weather) often result in reschedules or partial refunds per our policy.

  3. Continuous Improvement: Wespow conducts regular equipment inspections and staff training to meet or exceed international safety recommendations.

We understand that plans change. This Cancellation Policy explains how and when you can cancel, receive refunds or credits, and what charges may apply. All cancellations must meet the requirements below to be eligible for a refund or credit.


1. Cancelation by Guest

2. Cancellation by Wespow Adventures

  • If we cancel an activity for reasons within our control (staffing, equipment issues, etc.), you will receive either a full refund or a credit toward another date, at your option.

  • If cancellation is due to circumstances beyond our control (severe weather, natural disasters, safety risks, etc.), we will offer you the choice of:

    1. Rescheduling to another date, or

    2. A full refund of any amount paid for the cancelled activity.


3. Deposit & Payment Requirements

  • A non-refundable deposit may be required at time of booking to secure your reservation. The amount will be specified on the booking page / confirmation.

  • Full payment is required before or on the date of the experience. If full payment is not received in time, Wespow reserves the right to cancel the booking.


4. Group Bookings, Corporate, School, & Special Events

  • For groups, school trips, corporate bookings, or special events, customized cancellation windows may apply. These will be clearly communicated in writing when booking.

  • Typically, group cancellations follow stricter timelines (e.g. 7 to 14 days prior) to allow Wespow to adjust staffing, prepare resources, and manage logistics.

  • Within shorter notice periods for group bookings, cancellation fees may be higher or full payment forfeited.


5. How to Cancel or Change a Booking

  • To cancel or change your booking, contact Wespow via email: adventure@wespowadventures.com or through the booking portal. Verbal cancellations are not accepted.

  • Any change requests (date, number of people, package options) are subject to availability and any difference in cost. If changes are made less than 24-48 hours before the experience, fees may apply.


6. Refund Processing

  • Refunds will be processed using the same method used for payment, unless otherwise agreed.

  • Please allow up to 14 calendar days for refund processing (may vary by bank or payment method).

  • Any fees charged by banks, payment processors, or non-refundable portions (e.g. deposits) will be deducted before refund.


7. No-Show Policy

  • If you do not arrive for your activity at the scheduled time and location without having informed us per cancellation procedure, you will be considered a “no-show” and will not be eligible for any refund or credit.


8. Weather & Safety Related Cancellations

  • Wespow reserves the right to cancel, delay, or modify experiences due to weather, safety, or conditions which may put guests, staff, or equipment at risk.

  • In such cases, you will be offered a full refund or a credit toward a future date.

  • If the experience has begun and is ended prematurely for safety, refunds or credits may be prorated (proportionate to the portion of the experience delivered).


9. Special Circumstances

  • Cancellations for medical emergencies may be considered outside standard policy but must be supported by a medical certificate from a qualified professional or institution.

  • If external factors prevent you from attending (e.g. travel restrictions, flight cancellations), we will work with you to reschedule when possible or provide a credit. Refund decisions for these cases may be discretionary.


10. Additional Terms

  • Certain promotional, discounted, or bundle offers may have special cancellation or refund restrictions. These will be clearly noted at time of booking.

  • All cancellation requests must include your booking reference number and be accompanied by confirmation from us acknowledging receipt of your request.

  • Wespow reserves the right to amend this Cancellation Policy at any time. The version posted on our website at the time of your booking is the one that applies.

Frequently Asked Questions (FAQ)

Q: What should I bring with me, and what should I wear?
A: Closed-toe shoes are essential — sturdy sneakers or boots are best. Long pants are strongly recommended for ATV, horseback, and under-brush trails. Bring sunscreen, insect repellent, a change of clothes (you might get wet or muddy), a towel, and lots of water. Hat, sunglasses, and a small waterproof bag for valuables are good ideas too.


Q: Am I too young, too old, or too heavy for the rides?
A: Each experience has specific age, weight, and physical health requirements. Example, younger children must be accompanied by an adult for safety. Drivers of ATVs usually must be at least 16 and may require ID. Riders who exceed weight limits may be restricted for safety. If in doubt, contact us with your age, weight, and the ride of your interest.


Q: Do I need a driver’s license to ride an ATV?
A: Many ATV tours require a valid driver’s license for safety and regulatory compliance. If you don’t have one, we often have alternatives, such as riding as a passenger or using guided vehicles.


Q: Is safety gear provided, and will we get instructions before riding?
A: Absolutely. Safety gear — helmets, eye protection are provided and must be worn. Before every activity (ATV, horses, zip-line), guides give a full safety briefing that covers behavior on the ride, how to use the gear, what to do in emergencies, and how to respect the land and animals.


Q: What happens in bad weather or unsafe conditions?
A: Safety is non-negotiable. If the weather, trail conditions, or visibility make an activity unsafe (e.g. heavy rain, flooding, unstable terrain), we may delay, modify, or cancel that experience. In those cases, you will be offered options for rescheduling or, where applicable, refunds per our cancellation policy.


Q: Are meals, drinks, or restrooms available on site?
A: Yes — we have on-site amenities including restrooms, shaded resting areas, and café/food options.


Q: Can you accommodate groups, school trips, or corporate events?
A: Yes! We offer special programs for families, schools, and corporate groups. These can be customized for team building, learning outcomes, or special schedules. We recommend booking in advance to ensure we tailor the experience to your group’s needs.


Q: Is Wespow accessible for people with limited mobility or special needs?
A: We strive to make many of our cultural, farm, and nature-trail experiences accessible. However, some adventure rides (ATV, zipline, rugged horseback trails) require physical agility, balance, or weight-bearing capacity. Please contact us ahead of your visit so we can discuss what options are available and ensure your safety and enjoyment.


Q: What are the rules regarding cannabis tours?
A: Our cannabis tours are educational and strictly comply with Jamaican law. Participants must be 18+ and carry valid ID. Consumption on active rides or physically demanding activities is prohibited. Tour guides share the heritage, cultivation practices, and cultural significance, but all experiences are conducted in safe, regulated environments.


Q: How do I book, pay, and what if I need to cancel?
A: Booking is easiest via our website or reservation platform. We accept major credit cards and sometimes local currency for certain purchases. A deposit or full upfront payment is required depending on the experience. For cancellations, we have a policy that allows refunds or rescheduling with adequate notice. Please review the cancellation terms when you book.


Q: Do you offer transportation or hotel pick-ups?
A: Many of our experiences can include pick-ups from  hotels or resorts. If you require transport, please let us know when booking so we can arrange for a fee or include it in your package.


Q: How can I capture my experience? Are photos or video available?
A: Our team often takes action photos and videos during the more dynamic activities. You can purchase these as part of certain packages. You’re also welcome to bring your own camera/phone, provided it’s secured and doesn’t interfere with safety gear or the ride. For drones, we require device operated by a trained personnel.
